    Errant Bank and Banking ombudsman

    We have availed two loans from SBT Mylapra Branch, Pathanamthitta. Last instalment of the first loan was on Nov.2014 and we paid all the instalments. Second loan, on their own admission is running regular. Now the Bank started asking us to pay Rs.3.36 Lacs, sometimes 5.26 lacs on the first loan, when it is considered as closed since we paid all the instalments. When asked how they arrived at the figure, Bank is unable to answer clearly. We know that the Bank cannot collect fees or Interest retrospectively as per RBI instructions. So we lodged a complaint with Hon’ble Banking Ombudsman Trivandrum. The Banking Ombudsman has asked the Bank to recalculate and the Bank on recalculation found an excess of Rs.19, 376/- was collected from us and the Bank credited the amount in our account and as such we are surprised how the Bank is still demanding Rs. 3.36 Lacs and sometimes Rs. 5.26 Lacs. It seems they are NOT honouring ombudsman’s orders. So we again filed a petition before the Banking Ombudsman, Trivandrum to enforce their orders on the Bank. But to our surprise, Ombudsman regretted their “inability to reconsider the issue”. We have not asked them to reconsider, but to enforce their own orders on the Banks.
    Will the authorities open their eyes and restrain the Erring banks from adopting dubious means of collecting illegitimate money from the Public. We have instructed our lawyers to initiate criminal proceedings against this Bank for attempting extortion of money (culpable under CrPC) and for suitable monetary compensation for mental torture and agony being inflicted on us. It is a matter of concern that they do not write their names under their signature, they do not put a readable seal and they do not send full text of letters but part of it to confuse us.
